Article 1: General provisions

The e-commerce website of Marka, a private limited company with registered office at Meerbos 18, B-9260 Wichelen, Belgium, VAT BE0662 681 729, (hereinafter “Weefweelde”) offers its customers the opportunity to purchase products from its online store.

These General Terms and Conditions (‘Terms and Conditions’) apply to every order placed by a visitor to this e-commerce website (‘Customer’). When placing an order via the webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance and in writing by Marka BV.

Article 2: Price

All prices quoted are in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

Any delivery, reservation or administrative costs, if applicable, are always stated clearly and separately.

The price quoted refers exclusively to the items as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Article 3: Offer

Although the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding on Marka BV. It is only bound by an obligation of means as regards the accuracy and completeness of the information provided. Marka BV is in no way liable in the event of obvious material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service department in advance.

The offer is valid while stocks last and may be modified or withdrawn at any time. Marka BV cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

  • The customer selects the webshop product(s) and places them temporarily in a shopping basket.
  • During and/or at the end of the order, the customer will receive suggestions for products that either match the product, are a possible alternative, or are temporarily offered at a reduced price.
  • The customer receives an overview of the products and can make changes or remove items if desired.
  • At this point, the customer receives an overview of all prices, the total price including the (separately stated) shipping costs, if applicable.
  • If they agree, the customer confirms the order and fills in the billing and delivery details, after which an order form is created and the customer can proceed to payment either immediately online or by bank transfer.
  • Once payment has been received, an invoice is created and sent to the customer.
  • Marka BV checks the stock and prepares the order for shipment. If one or more products are out of stock, it notifies the customer and informs them of the planned delivery time.

 

The Customer can choose between the following payment methods:

  • via Bancontact / QR code
  • via bank card
  • via Belfius Direct Net
  • via KBC Payment Button
  • via bank transfer to Marka BV’s account number BE46 6451 0455 6436

Marka BV is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders involving the Customer.

 

Article 5: Delivery and performance of the agreement

All goods, if in stock, will be shipped within a maximum of 5 working days.

For goods that are not in stock, Marka BV will contact the buyer and, depending on availability, provide an indicative, non-binding delivery time. The customer is free to cancel this part of the order if, in their opinion, the delivery time is too long.

We charge a standard shipping cost of €7.99 including VAT. No shipping costs will be charged for purchases over €300, provided that all goods can be shipped at the same time.

Shipments are made by bpost. Once shipped, the customer will receive a track & trace code by email.

Every shipment is insured by the seller.

Items ordered through this webshop are delivered in Belgium, the Netherlands, Luxembourg and France.

Any visible damage and/or quality defect in an item or other defect in the delivery must be reported immediately by the Customer to Marka BV by email with the “delivery confirmation” option to info@mirrix.eu with a description and photo of the damage attached.

The customer will receive a confirmation of receipt and will be contacted as soon as possible to resolve the problem.

The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier if the Customer has instructed the goods to be transported by a service other than Marka BV’s standard carrier.

 

Article 6: Retention of title

The delivered items remain the exclusive property of Marka BV until full payment has been made by the Customer.

The Customer undertakes to inform third parties of Marka BV’s retention of title if necessary, e.g. to anyone who might seize items that have not yet been paid for in full.

 

Article 7: Right of withdrawal

 

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from Marka BV.

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the goods. If the total order is shipped in partial deliveries, the date of receipt of the specific item applies and not the totality of the order.

For agreements concerning regular delivery of goods during a certain period, the date on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the first item applies.

To exercise the right of withdrawal, the Customer must inform Marka BV, Meerbos 18, 9260 Wichelen, Belgium, of their decision to withdraw from the agreement by means of an unambiguous written statement sent by registered post or by email with the “delivery confirmation” option. If this is done by email, the Customer must retain proof of dispatch in order to be able to present it at the express request of Marka BV. The Customer may use a model withdrawal form for this purpose, which can be obtained from Marka BV on request, but is not obliged to do so.

In order to comply with the withdrawal period, the Customer must send his notification of his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Marka BV without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Marka BV. The Customer is on time if he returns the goods before the 14-calendar-day period has expired.

The direct costs of returning the goods are borne by the Customer.

The Customer is requested to return the items in their original condition and packaging, with all accessories and instructions supplied. If the returned product has diminished in value in any way, Marka BV reserves the right to hold the Customer liable and claim compensation for any diminution in value of the goods resulting from the Customer’s use of the goods beyond what is necessary to determine the nature, characteristics and functioning of the goods.

All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned items may not have been used. If an item has suffered a reduction in value due to use by the Customer, this will be charged to the Customer.

If the Customer revokes the agreement, Marka BV will refund all payments received from the Customer up to that point, including the standard delivery costs, to the Customer no later than 14 days after it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever is earlier.

Any additional costs resulting from the Customer’s choice of a different method of delivery than the cheapest standard delivery offered by Marka BV will not be refunded.

Marka BV will refund the Customer using the same payment method that the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such a refund.

The Customer cannot exercise the right of withdrawal for:

  • the delivery of goods manufactured according to the Customer’s specifications, or which are clearly intended for a specific person;
  • the delivery of goods which, by their nature, are irrevocably mixed with other products after delivery;
  • agreements where the Customer specifically requested Marka BV to visit them to carry out urgent repairs or maintenance;
  • agreements concluded during a public auction;
 

Article 8: Warranty

 

Pursuant to Article 1649quater of the old Civil Code, consumers have legal rights. This legal warranty is valid for two years from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact customer service and return the item to Marka BV, Meerbos 18, 9260 Wichelen, Belgium.

If a defect is found, the Customer must inform Marka BV as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been discovered. After this period, any right to repair or replacement expires.

The (commercial and/or legal) warranty never applies to defects resulting from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the item, rough use, poor maintenance, or any other abnormal or incorrect use.

Article 10: Penalties for non-payment

 

Unless expressly agreed otherwise in writing, the invoice is payable in cash. In the event of non-payment of all or part of the price, the provisions of Book XIX of the Economic Law Code shall apply, and the seller shall send the customer a free reminder to pay the amount due within 14 calendar days. If the customer does not pay within that period, the outstanding amount shall be increased by annual interest calculated at the reference interest rate plus eight percentage points referred to in Article 5, second paragraph, of the Act of 2 August 2002 on combating late payment in commercial transactions, calculated from the calendar day following the day on which the free reminder was sent to the customer, as well as a fixed compensation of:

  1. 20 euros if the balance due is less than or equal to 150 euros;
  2. 30 euros plus 10% of the amount due in the bracket between 150.01 and 500 euros if the balance due is between 150.01 and 500 euros;
  3. 65 euros plus 5% of the amount due in the bracket above 500 euros, with a maximum of 2000 euros if the balance due is higher than 500 euros.

Without prejudice to the foregoing, Marka BV reserves the right to take back items that have not been paid for (in full).

The personal data you provide will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to access and, if necessary, correct, supplement or delete your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be restricted. You may also object to the processing of your personal data if you have serious and legitimate reasons that outweigh our need to process your data. By sending a written, dated and signed request to Marka BV, Meerbos 18, 9260 Wichelen, Belgium, email order@weefweelde.be, you can request your personal data in digital and readable form free of charge and/or have it transferred to other controllers. Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.

In the case of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge and without giving any reason.

If any provision of these Terms and Conditions is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.

Failure by Marka BV at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any of these rights, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.

 

Article 14: Amendment of terms and conditions

 

These Terms and Conditions are supplemented by other terms and conditions to which explicit reference is made, and by the general terms and conditions of sale of Marka BV. In the event of any conflict, these Terms and Conditions shall prevail.

 

Article 15: Evidence

 

The Customer accepts that electronic communications and backups may serve as evidence.

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The court of Dendermonde has jurisdiction in the event of legal disputes. The Consumer may also refer to the ODR platform (http://ec.europa.eu/consumers/odr/).
